These Terms and Conditions (these “Terms”) govern your order and purchase of any SayCure E Services Pvt Ltd (the “Products”) on the webstore at www.saycure.in  (the “Store”).

BY ACCESSING OR PLACING AN ORDER ON OUR STORE, YOU ARE AGREEING TO BE BOUND BY THESE TERMS. ALL ADDITIONAL GUIDELINES, TERMS, OR RULES ON THE STORES, INCLUDING THE GENERAL  & THE PRIVACY POLICY ARE INCORPORATED BY REFERENCE INTO THESE TERMS AND YOU ARE AGREEING TO ACCEPT AND ABIDE BY THEM BY ACCESSING OR PLACING AN ORDER ON THE STORE.

       I.            License

License Grant. Subject to Your compliance at all times with these Terms, SayCure grants, under all of its rights in and to the Services, a worldwide, non-sublicensable, non-transferable, non-exclusive, revocable, limited license to use the Services solely for Your personal use, to use, manage and monitor Your Products and collect and receive data from Your Products.

Limitations on Use.

1. The Services and its contents, features and functionality (including, without limitation, all information, software, text, graphics, images, controller and audio, and the design, selection and arrangement thereof) (collectively, the “Content”) are protected by India and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
2. You shall not directly or indirectly do any of the following:
   1. sell, offer for sale, lease, license, sublicense or distribute the Services or any Content;
   2. copy, reproduce, broadcast, transmit, republish, distribute, modify, prepare derivative works of, perform, publicly perform or display any Content in any way without the prior written permission of SayCure and its applicable licensors;
   3. remove or alter any copyright, trademark or other proprietary rights notices from the Content, or use the Content in contravention of any such applicable notices;
   4. copy, modify, or create derivative works of, or reverse engineer, decompile, translate, disassemble, or otherwise attempt to extract the source code of, any software included in the Services.
   5. violate any third party rights or any local, state, national or international law or regulation;
   6. transmit or create any materials that are abusive, harassing, tortious, defamatory, libelous, harmful, fraudulent, deceptive, threatening, vulgar, obscene, invasive of another’s privacy or otherwise objectionable;
   7. transmit any material that contains adware, malware, spyware, software viruses, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
   8. impersonate any person or entity, or otherwise misrepresent Your affiliation with a person or entity;
   9. engage in any High Risk Activities
   10. jeopardize the security of Your account or anyone else’s account, or attempt, in any manner, to obtain the password, account, or other security information from any other user;
   11. interfere with, disrupt or attempt to gain unauthorized access to the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services;
   12. remove, circumvent, disable, damage, or otherwise interfere with security-related features of the Services
   13. create a substantially similar product or service thereto, or to any component thereof; or
   14. violate any applicable law or regulation or accompanying user or technical manuals, training materials, specifications, or other documentation pertaining to any services, whether in digital or printed format.
3. You are responsible for obtaining and maintaining all equipment and services needed for access to and use of the services and for paying all charges related thereto.

    II.            Order and Pricing

1. We may, in our sole discretion, refuse or cancel any order and limit order quantity. You agree that your order is an offer to buy the Products or services listed in your order. Your receipt of a confirmation from us, however, does not constitute an acceptance of your order; we are simply confirming that we received your order. We reserve the right at any time after receiving your order to accept or decline your order for any reason. If we cancel your order, we will refund you the full amount paid.
2. We strive to communicate accurate pricing and Product information but will not be held responsible for any pricing, typographical or other errors in such communications. Additionally, we may make changes to any Product or services offered on any of the Stores, or to the applicable prices for any such Products or services, at any time, without notice. The materials on the Stores with respect to Products and services may be out of date, and we make no commitment to update the materials on the Stores with respect to such Products and services.
3. Prices shown are in Indian Rupees. If you are paying for your order with an international credit card, please note that the purchase price may fluctuate with exchange rates. In addition, your bank or credit card issuer may also charge you foreign conversion charges and fees, which may also increase the overall cost of your purchase. Please contact your bank or credit card issuer regarding these fees.

Saycure will provide assistance and support throughout the warranty claim process, including facilitating communication between the customer and the manufacturer.

1. Manufacturer’s Terms and Conditions: Customers are responsible for familiarizing themselves with the manufacturer’s warranty terms and conditions, including any limitations or exclusions. The manufacturer’s warranty may cover repairs, replacements, or refunds at the discretion of the manufacturer.

1. Exclusions from Warranty Coverage: The manufacturer’s warranty may not cover damages or defects resulting from misuse, accidents, unauthorized modifications, or normal wear and tear. Customers should adhere to the manufacturer’s guidelines for product usage and maintenance to ensure warranty eligibility.

1. Limitation of Liability:Saycure acts solely as a facilitator between the customer and the manufacturer for warranty-related issues.  IV.            Shipping

1. Shipping Methods: We offer several shipping options to suit your needs, including standard shipping, expedited shipping, and express shipping. The shipping method you choose will determine the delivery timeframe and associated costs.
2. Shipping Rates: Shipping rates are calculated based on factors such as the shipping destination, package weight, and selected shipping method. You can view the shipping costs for your order during the checkout process before making payment.
3. Delivery Timeframe: The delivery time frame varies depending on your location and the shipping method selected. Standard shipping typically takes 3–10 business days for domestic orders, while expedited and express shipping options offer quicker delivery times.

    V.            Returns

1. Change of Mind. Customers have the right to cancel the order and return the Product, within 15 days from the delivery date; provided that you shall be responsible for all return shipping costs of the The Product that is being returned should be in following condition only then the return would be accepted :
   1. The product should be in proper packaged condition
   2. The product should be unused, not damaged or broken
   3. The bill needs to provided with the package

3. Defective Products
   1. Defective Products purchased from the Store may be returned for replacement.
   2. To submit a request for repair or replacement of any defective Products, Contact us.

 VI.            Limitations of Warranty and Liability

The warranty for the Product is set forth in the Limited Warranty.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAYCURE DOES NOT MAKE ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO ANY PRODUCT OR SERVICE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR NON-INFRINGEMENT. ANY STATEMENTS OR REPRESENTATIONS ABOUT THE PRODUCTS AND ITS FEATURES OR FUNCTIONALITY AND ANY COMMUNICATION WITH YOU IS FOR INFORMATION PURPOSES ONLY, AND DOES NOT CONSTITUTE A WARRANTY OR REPRESENTATION. WITHOUT LIMITING THE FOREGOING, SAYCURE DOES NOT WARRANT THAT THE OPERATION, OUTPUT OR IMPLEMENTATION OF THE PRODUCTS WILL: (I) MEET YOUR REQUIREMENTS; (II) BE UNINTERRUPTED, ERROR-FREE, ACCURATE, RELIABLE OR COMPLETE; (III) BE COMPATIBLE WITH YOUR HOME NETWORK, COMPUTER OR MOBILE DEVICE; OR (IV) THAT SAYCURE OR ANY THIRD PARTY WILL RESOLVE ANY PARTICULAR SUPPORT REQUEST OR FIX ANY ERRORS OR THAT SUCH RESOLUTION WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
2. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES WILL SAYCURE OR ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, AGENTS OR LICENSORS BE LIABLE UNDER ANY THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STATUTORY OR OTHERWISE) FOR ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF MONEY, REVENUES, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SUCH PARTIES WERE ADVISED OF, KNEW OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OR PURCHASE OF ANY PRODUCT ON ANY STORE, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE). IF, NOTWITHSTANDING THESE TERMS, SayCure IS FOUND TO BE LIABLE, THE LIABILITY OF SAYCURE AND ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, AGENTS, OR LICENSORS TO YOU OR TO ANY THIRD PARTY IS LIMITED TO THE FEES ACTUALLY PAID BY YOU TO SAYCURE FOR THE SERVICES OR PRODUCT AT ISSUE IN THE PRIOR 12 MONTHS. THIS LIMITATION IS CUMULATIVE AND WILL NOT BE INCREASED BY THE EXISTENCE OF MORE THAN ONE INCIDENT OR CLAIM. To the extent that SayCure may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of SayCure’s liability will be the minimum permitted under such applicable law.

VII.            End User Only.

 Products purchased on the Store are for use by end-users only, and your order may be refused or canceled if it is suspected that you are purchasing Products for resale.

VIII.            Intellectual Property Ownership.

All copyrights, trade secrets, patents, trademarks and other intellectual property and proprietary rights in any jurisdiction worldwide (collectively, “Intellectual Property Rights”) in and to the Services and the Content are the sole property of SayCure or its licensors. You do not have or receive any right, title or interest in or to the Services or the Content through Your use of the Services or otherwise.

All trademarks, service marks, trade names and logos and the goodwill associated therewith (“Marks”) included or displayed in the Services or Content are the exclusive property of SayCure or their respective holders. You are not permitted to use any of the Marks without the applicable prior written consent of SayCure or such respective holders.

User Submissions.

1. SayCure does not claim ownership of any information, data, text, images or other materials You or Your devices submit for display, processing, temporary storage or distribution through the Services (collectively, “User Submissions”). As between SayCure and You, You own all rights to Your User Submissions. SayCure does not pre-screen User Submissions and You agree that You are solely responsible for all of Your User Submissions. SayCure is not required to host, store, process, display, return or distribute any User Submissions, and may remove Your User Submissions at any time. SayCure is not responsible for any loss, theft or damage of any kind to any User Submissions. You represent and warrant that Your User Submissions, and SayCure’s use thereof, do not and will not infringe the rights of any third party (including, without limitation, Intellectual Property Rights, rights of privacy or publicity, or any other legal or moral rights).
2. In addition, You hereby grant to SayCure, without obligation, compensation, or restriction of any kind or nature, the worldwide, non-exclusive, perpetual, irrevocable, royalty free, fully paid up right: (i) to copy, reproduce, broadcast, transmit, republish, distribute, modify, prepare derivative works of, perform, publicly perform and display any User Submissions and any copies thereof, in any format or medium now known or later developed, and including as embodied in any Product; (ii) to make, have made, use, license, rent, lease, sell, offer for sale and import the User Submissions and any copies thereof. SayCure reserves the right to display advertisements in connection with User Submissions and to use User Submissions for advertising and promotional purposes.

 IX.            Data; Confidentiality

1. You agree that SayCure may from time to time collect and use data in a form that could personally identify You (such as Your name, email address, mailing address or other contact information) or Your customers (collectively “Personal Data”), for any reason, including to facilitate the provision of updates to any applications or services, promote new Products and Services, authenticate Products, verify compliance with these Terms, and improve Products. Your usage and Personal Data is governed by SayCure’s Privacy Policy.
2. SAYCURE CARES ABOUT THE INTEGRITY AND SECURITY OF YOUR PERSONAL DATA. HOWEVER, SAYCURE CANNOT GUARANTEE THAT UNAUTHORIZED THIRD PARTIES WILL NEVER BE ABLE TO DEFEAT OUR SECURITY MEASURES OR USE YOUR PERSONAL DATA FOR IMPROPER PURPOSES. YOU ACKNOWLEDGE AND AGREE THAT YOU PROVIDE YOUR PERSONAL DATA AT YOUR OWN RISK.

    X.            Indemnification.

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS SAYCURE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, EXPENSES AND FEES (INCLUDING REASONABLE ATTORNEYS’ FEES) THAT SUCH PARTIES MAY INCUR AS A RESULT OF OR ARISING FROM A VIOLATION OF THESE TERMS BY YOU OR ANY AUTHORIZED USER’S ACCESS TO THE SERVICES. YOU AGREE NOT TO SETTLE ANY SUCH CLAIM WITHOUT SAYCURE’S  PRIOR WRITTEN CONSENT. SAYCURE RESERVES THE RIGHT, AT ITS OWN EXPENSE, TO ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF ANY MATTER OTHERWISE SUBJECT TO INDEMNIFICATION BY YOU, AND IN SUCH CASE, YOU AGREE TO COOPERATE WITH SAYCURE’s DEFENSE OF SUCH CLAIM.
